Right to Information and Information Privacy

The Right to Information Act 2009 (RTI Act) provides a formal means of requesting access to general information held by the Department that is not normally publicly available, unless it contains information which is exempt or which is contrary to public interest.

The Information Privacy Act 2009 (IP Act) provides a formal means of requesting access to, and amendment of your personal information. Formal access applications under Right to Information or Information Privacy should only be made as a last resort, where information is not otherwise accessible.

The Right to Information Act 2009 and the Information Privacy Act 2009 aims to:

  • make more information available
  • provide equal access to information across all sectors of the community
  • provide appropriate protection for individuals' privacy

This legislation replaces the former Freedom of Information Act 1992.

Did you know you have the right to access information held by Council?

Hinchinbrook Shire Council collects and stores information about the region, properties, land, and even animals. New legislation supports your access to much of this information while maintaining appropriate access restrictions for personal or confidential information.
