Dividing fences or trees are generally a private matter between neighbouring property owners.
Council does not determine or become involved in fence ownership, maintenance responsibilities, boundary locations, or cost-sharing arrangements.
The rights and responsibilities of neighbouring property owners are governed by the Neighbourhood Disputes (Dividing Fences and Trees) Act 2011. Property owners are encouraged to discuss fencing matters with their neighbours and reach an agreement before undertaking fencing and tree work.
If an agreement cannot be reached, assistance may be sought through the Queensland Civil and Administrative Tribunal (QCAT), which can make decisions about dividing fence and tree disputes under the Queensland Civil and Administrative Tribunal Act 2009.
